GENERAL TERMS AND CONDITIONS OF SALE

1. PREAMBLE AND SCOPE
These General Terms and Conditions of Sale (the "Terms of Sale") apply to all sales of products concluded via the website http://thecruvault.com/ (the "Site") between The Cru Vault ("we", "us", "our"), a company registered in France, and any consumer or non-professional buyer ("you", "the Customer").
By placing an order on our Site, you unreservedly accept these Terms of Sale. These Terms prevail over any other document.

2. PRODUCTS AND AVAILABILITY
2.1. Nature of Products
We specialize in the sale of rare, vintage wines and spirits on the secondary market.
2.2. Condition of Bottles
We describe the condition of each bottle (level, label, capsule) as accurately as possible. However, due to the age of the products, photographs are for illustrative purposes and the actual appearance may vary slightly due to the passage of time.
2.3. Availability
Our offers are valid as long as they are visible on the Site and within the limits of available stocks. Most of our products are unique items (single bottles). In the exceptional event that a product becomes unavailable after you have placed an order (e.g., inventory error or breakage during preparation), we will inform you immediately and refund the full amount paid.

3. PRICES AND TAXES
3.1. Currency
All prices are displayed in Euros (€) or the currency selected by the Customer on the Site.
3.2. Taxes (EU vs Non-EU)
- For orders shipped within the European Union: Prices include applicable VAT (Value Added Tax).
- For orders shipped outside the European Union: Prices are expressed exclusive of French taxes.
3.3. Import Duties
For international shipments outside the EU, you are the importer of the product. Customs duties, local taxes, import duties, or state taxes may be liable to be paid. These duties and sums are not the responsibility of The Cru Vault. They shall be borne by you and are your sole responsibility, both in terms of declarations and payments to the relevant authorities in your country.

4. ORDERS AND CONTRACT CONCLUSION
The confirmation of the order implies acceptance of these Terms of Sale. The sale will be considered final only after the sending of the order confirmation email by The Cru Vault and the collection of the full price. We reserve the right to cancel or refuse any order from a customer with whom there is a dispute regarding the payment of a previous order.

5. PAYMENT
Payment is due immediately upon ordering. We accept payments via the secure methods indicated on the Site (Credit Card, Apple Pay, etc.). The transaction is immediately debited after verification of the information. In the event of an error or inability to debit the card, the sale is immediately resolved by operation of law and the order canceled.

6. RETENTION OF TITLE
The Cru Vault retains full and entire ownership of the products sold until the price has been fully collected, in principal, costs, and taxes included.

7. DELIVERY AND TRANSFER OF RISK
7.1. Carrier and Timeframe
Deliveries are made via Chronopost Express. The average preparation and shipping time is between 8 to 15 business days, allowing for careful inspection and secure packaging of your items.
7.2. Transfer of Risk
The risk of loss or damage to the products is transferred to you at the moment you (or a third party designated by you) physically take possession of the goods.
7.3. Inspection upon Receipt
You are required to inspect the condition of the packaging and the contents upon delivery. In the event of damage (breakage, leakage, missing bottle), you must:
- Refuse the package or issue clear and precise reservations on the delivery slip.
- Notify The Cru Vault within 24 hours at contact@thecruvault.com with photos of the damage.

8. VINTAGE WINE DISCLAIMER (QUALITY)
The wines and spirits sold by The Cru Vault are often old vintages. While we guarantee the authenticity and the storage conditions while in our possession, we cannot guarantee the "drinkability" or the specific taste profile of wines aged for several decades. Taste being subjective and dependent on the evolution of the cork and liquid over time, no returns will be accepted based solely on the organoleptic quality (taste) of the wine, provided the product corresponds to its description.

9. LEGAL RIGHT OF WITHDRAWAL
In accordance with EU law, you have a period of 14 days from the receipt of your products to exercise your right of withdrawal without having to justify your reasons or pay a penalty.
Conditions for return: The products must be returned in their original condition, unopened, with the cork and capsule intact, and in their original packaging.
Costs: You are responsible for the return shipping costs. We recommend using a tracked and insured shipping method, as you are responsible for the product until it reaches our facility.

10. GOVERNING LAW AND DISPUTES
These Terms of Sale are subject to French law. In the event of a dispute, an amicable solution will be sought before any legal action. In the absence of an amicable agreement, the French courts shall have exclusive jurisdiction.
